The Punjab and Haryana High Court held an landmark judgment that an tenant cannot be deprived of electricity even if tenancy lease has been expired while he is in possession of the suit property.
The Hon’ble Court held that electricity is an basic necessity of life. The Hon’ble Court delivered the judgement on December 19, 2022, and directed to restore the electricity connection of a suit property, observed that the electricity is a basic necessity and is an integral part of right to life as enshrined under Article 21 of the Constitution of India.
Therefore, a tenant having a possession of the suit property cannot be deprived of the electricity. The electricity is an integral part of Right to life (Fundamental Right under Article 21).
